ARTICLE I. CLASS ELECTIONS
SECTION 1. An election in which each class (freshman, sophomore, junior and senior) takes part separately shall be considered a class election.
SECTION 2. The following officers shall be decided in class elections: president, vice-president, secretary, and treasurer.
SECTION 3. Election Procedures.
CLAUSE A. Nominations to the elective class officers shall be made by petition. Each petition shall contain the signatures of a least fifty (50) students.
The eligibility of all candidates for any elected office is stated in the petition packet.
CLAUSE B. Only members of the designated class shall be eligible to vote at and designated class election.
CLAUSE C. The Australian ballot shall be used.
CLAUSE D. To win, a candidate for a class office must receive a plurality of the votes cast.
CLAUSE E. When a candidate runs unopposed, a plurality of all votes cast shall be required.
CLAUSE F. Senior, Junior and Sophomore class officers elected during the spring election, shall assume their respective duties during the last week of
the spring semester and serve for one (1) year.
ARTICLE II. FINANCES
SECTION 1. ASB Budget
CLAUSE A. All financial decisions must be made by the ASB Council by simple majority vote.
CLAUSE B. All financial decisions made by the ASB Council must appear in the ASB Council minutes.
CLAUSE C. Monthly budget reports will be submitted by a designated financial officer, or Treasurer to the ASB Council for review.
CLAUSE D. Funds budgeted and not used by an ASB activity shall revert to the ASB general fund on July 1st, unless otherwise specifically encumbered and
be used the following year.
SECTION 2. Club and Organization Finances
CLAUSE A. Each Treasurer of a club/organization shall maintain financial records, which shall be available to the ASB Treasurer for periodic audit.
CLAUSE B. All activities for any club/organization that involves fundraising, monies collected or purchase of product in the name of San Pasqual Academy
must be an approved activity at least one (1) week in advance of the activity.
CLAUSE C. All tickets and bids needing to be sold by any approved San Pasqual Academy club/organization must be approved by the Treasurer and sold
through the Student Store or Concessions.
CLAUSE D. No money shall be paid from the funds of any San Pasqual Academy club/organization except upon the presentation of the proper paperwork
completed in a manner designated by the principal. Purchases made without the proper procedure will be considered a liability of the purchaser.
CLAUSE E. Each faculty club/organization sponsor may request a statement of the club financial transactions and the current balance of the
club/organization account from the school’s designated financial officer or Treasurer.
ARTICLE III. SCHOOL ACTIVITIES AND EVENTS
SECTION 1. All co-curricular and extra-curricular school activities and events including social and fundraising activities, and field trips, must be placed on the
master school calendar.
SECTION 2. Any social activities that engage in fundraising for school purposes, outside of athletics must be approved by the ASB council.
SECTION 3. Plans for all events and activities must be submitted on an “Activity/ Facility Reservation Form” to the ASB Advisor or Administrative Assistant for
approval at least three (3) weeks prior to the date of the activity.
SECTION 4. Plans for activities and events must conform to district procedures.
ARTICLE IV. DUTIES OF COMMISSIONERS
SECTION 1. Commissioner of Academics
CLAUSE A. To be eligible for this position, a student must have at least a 3.0 cumulative grade point average (CGPA).
CLAUSE B. The Duties of the Commissioner of Academics shall be as follows:
1. The student shall be responsible for promoting academic excellence among the students of San Pasqual Academy High School.
2. The student shall keep a record of the grades (both citizenship and scholarship) of the current ASB Council; members to be sure everyone
is meeting the minimum criteria for holding office.
3. The student shall be responsible for offering awards at the end of each progress report and at the end of each semester to San Pasqual
Academy students with high academic achievement and/or perfect attendance.
4. The student shall be performed about and support the different academic clubs on campus, attending at least one meeting of each
academic club on campus, and making frequent reports to the ASB Council on the activities and status of the clubs.
5. The student shall assume any additional responsibilities and/or duties as specified in the by-laws of the constitution.
6. The student shall have one (1) vote in the student council.
SECTION 3. Commissioner of Activities
CLAUSE A. The duties of the Commissioner of Activities shall be as follows:
1. The student shall be the general director for all of the school’s social activities.
2. The student shall report regularly to the council and senate for ideas concerning activities of interest to the ASB.
3. The student shall be in charge of assembly programs.
4. The student shall be responsible for keeping a permanent file all ASB activities for the year.
5. The student shall have one (1) vote on the council.
SECTION 4. Commissioner of Athletics
CLAUSE A. The Duties of the Commissioner of Athletics shall be as follows:
1. The student shall meet with the athletic department regularly and report regularly to the council and senate on the status of athletic
events.
2. The student shall meet regularly with the Commissioners of Publicity and Pep regarding all athletic activities.
3. The student shall be responsible for publicity for all athletic terms and events.
4. The student shall work with the Commissioner of Pep, to plan pep
5. Printing of programs for athletic events, concessions, and booster buses.
6. The student shall work with the Commissioner of Finance to order spirit items for the student store.
7. The student shall assume any additional; responsibilities and/or duties as specified in the by-laws of the constitution.
8. The student shall have one (1) vote on the council.
SECTION 5. Commissioner of Elections and Eligibility
1. The student shall have direct supervision over all ASB elections.
2. The student shall have the authority to be chairperson and appoint members for an election committee.
3. The student shall have supervision over all class elections.
4. The student shall be responsible for checking eligibility of candidates for all ASB and class elections.
5. The student shall assume any additional responsibilities and/or duties as specified in the by-laws of this constitution
6. The students shall have one (1) vote on the council.
7. The student shall be responsible for the submission to the council and principal all budget plans for the school year, and shall compile the
approved budget plans into an official document.
8. The student shall be responsible for reporting at regular intervals to the council and the senate an accurate account of the student body status.
9. The student shall be responsible for signing all financial requisitions pertaining to ASB funds.
10. The student shall have (1) vote on the council.
SECTION 6. Commissioner of Publicity
CLAUSE A. The duties of the Commissioner of Publicity shall be as follows:
1. The student shall be responsible for distributing publicity to local media such as a press, radio, and television.
2. The student shall serve as the public relations person for the ASB.
3. The student shall approve all publications of clubs and posters that will be posted in the halls, including all posters and/or banners belonging to
a candidate in an election.
4. The student shall be in charge of all publicity for all ASB activities.
5. The student shall work with the SPA code and the Annual to ensure coverage of school events in both of the school publications.
6. The student shall be in charge of coordinating the use of all school showcases and bulletin boards.
7. The student shall be responsible for maintaining the official ASB bulletin board and school marquee.
8. The student shall assume any additional responsibilities and/or duties as specified in the by-laws of this constitution.
9. The student shall have one (1) vote on the council.
SECTION 7. Commissioner of Pep Rally
CLAUSE A. The Duties of the Pep Rally Commissioner shall be as follows:
1. The student shall be the liaison between the ASB and the performing groups (Cheersquad, Auxiliary, ROTC, all dance groups,etc.)
2. The student shall be responsible with the performing groups for:
A. Promoting school spirit and school support t rallies, athletic, cultural and academic events.
B. Promoting the highest standards of sportsmanship among the San Pasqual High School student body.
3. The student shall be responsible with the other performing groups for planning pep rallies, assemblies, and other events, which will further
promote school spirit and sportsmanship.
4. The student shall be responsible for decorating at all home games.
5. The student shall be responsible with the Commissioner of Elections to plan the spring selection of cheer squad members.
6. The student shall responsible with the performing groups in assisting with plans for homecoming week and homecoming game activities.
7. The student shall be responsible with the cheer a squad and other performing groups for planning and carrying out a minimum of fundraising
activities to help defray the cost of uniforms, equipment, camp, transportation, etc.
8. The student shall assume any additional responsibilities and/or duties as specified in the by-laws of this constitution.
9. The student shall have one (1) vote on the council.
SECTION 8. Commissioner of Technology
CLAUSE A. Duties of the Commissioner of Technology shall be as follows:
1. Oversee use of music and video during ASB activities including, but not limited to, Pep Rally and dances.
2. Approve songs played during dances and pep rally for PA system.
3. Compose original music and videos for Pep Rallies.
4. Set up all technology for dances and events.
SECTION 9. Commissioner of Concessions
CLAUSE A. Duties of the Commissioner of Concessions shall be as follows:
1. Handles money for concessions.
2. Ensures cleanliness of snack bar.
3. Makes list for shopping (leads shopping trip)
4. Keeps inventory of items in snack bar.
5. Works all concessions.
SECTION 10. Senior, Junior, and Sophomore Class Officers
CLAUSE A. The Duties of the Senior, Junior, and Sophomore Class Presidents shall be as follows.
1. Each class president shall submit class a class budget by November 1st to the council, principal, class advisor, and financial secretary, which
will include all anticipated income and expenses for the year.
2. Each class president shall coordinate social and money making activities within the class.
3. Each class president will establish an executive council to work with the elected officers in planning and coordinating class activities.
4. Each class president shall meet at least every once every two (2) weeks with the class officers and the class advisor.
5. Each class president shall be responsible for communicating regularly with the entire class by way of class meeting, assembly, closed circuit
television and/or newsletter.
ARTICLE V. DUTIES OF OFFICERS
SECTION 1. ASB President
CLAUSE A. ASB Advisor appoints ASB President.
CLAUSE B. To be eligible for the office of ASB President the student must have been a member of the associated student body for at least two (2)
semesters immediately processing the term of office.
CLAUSE C. The Duties of the President shall be as follows:
1. The student shall be the official representative of the associated student body of San Pasqual Academy High School in its relations with other
schools, with the administration and faculty, with all organized groups within the school, and with the community.
2. The student shall be the presiding officer at the council meeting and
parliamentarian at the senate meetings.
3. The student shall be an ex-official member of all councils and
committees of the ASB council.
4. The student shall be responsible for the general supervision of the
other elected officers.
5. The student shall confer with the appointed student sponsor and the
principal to acquaint them with the proceedings of the associated
student body.
6. The student shall serve as one of the student representatives on the
School Site Council.
7. The student shall require each officer to keep a record of their
activities during the year with suggestions for future council members.
These records will become part of the permanent records available for
future ASB councils.
8. The student shall keep a record of duties during the year with
suggestions for future council members.
9. The student has general responsibility over the activities of the ASB.
10. The student shall work for unity with other schools.
11. The student shall assume any additional responsibilities and/or duties
as specified in the by-laws of this constitution.
12. The student will have no vote except in the case of a tie.
SECTION 2. ASB Vice President
CLAUSE A. ASB Advisor appoints ASB Vice President.
CLAUSE B. To be eligible for the office of vice-president, the student must
have been a member of the associated student body for one (2) semesters
immediately preceding the term of office.
CLAUSE C. The Duties of Vice-President shall be as follow:
1. The student shall succeed to the presidency in the event of a vacancy
in the office.
2. In the case of the absence of the president, the vice-president shall
assume the duties of the president until the president’s return.
3. The student shall act as parliamentarian of the meeting as presiding
officer of the senate.
4. The student shall coordinate all community service projects.
5. The student shall assume any additional responsibilities and/or duties
as specified in the by-laws of this constitution.
6. The student shall have one (1) cote in the student council.
SECTION 3. Interns
CLAUSE A. The ASB President, Advisor, and Council shall decide the Duties of
the Interns.
CLAUSE B. Appointment of Interns
1. The Interns shall be appointed by the ASB President with the
assistance of the Commissioner of Elections and an election
committee, and approved by the ASB Advisor.
2. No more than four (4) and no less than two (2) Interns shall be
appointed to serve on the ASB council at one time.
3. The interns shall assume any additional responsibilities and/or duties
as specified in the by-laws of this constitution.
4. Each intern shall have one (1) vote on the council.
SECTION 4. The ASB/Senate Secretary
CLAUSE A. ASB Advisor appoints the ASB/Senate Secretary.
CLAUSE B. The Duties of the ASB Secretary shall be as follows:
1. The student shall keep accurate minutes of all the ASB council and
senate proceedings.
2. The student shall be responsible for collection and recording
information including newspaper articles, letters, and pictures of all
student events in a specified album.
3. The student shall perform other clerical duties as be assigned by
the ASB President.
4. The student shall assume any additional responsibilities and/or duties
as specified in the by-laws of this constitution.
ARTICLE VI. ASB SENATE
SECTION 1. Selection of Senators
CLAUSE A. The Senate shall be composed of elected representatives (Senators), one
from each First Period class, and shall include the ASB Council.
1. Senators will consist of one student per first period class.
2. Every first period teacher will nominate their top two or three students based on the following criteria:
a. Student must have no office referrals in the prior three months
b. Student should have a minimum 2.5 GPA or higher and currently not hold a failing grade.
c. Student should be an active member of class
3. Each first period teacher will have the discretion to pick a student(s) that best fits the above criteria if no student meets these criteria.
4. Once a teacher has nominated students, the teacher has full discretion of whether the nominees should be allowed to debate one another.
5. The class will then vote for a nominee. A simple majority vote will decide the representative for that class.
SECTION 2. Duties of the Senate
1. The Senate shall have the authority to pass all by-laws and
Amendments to the constitution by a two-thirds (2/3) majority vote,
2. All proposed by-laws and amendments must be distributed
to all senators in written form at one (1) week before a regular
meeting of the senate.
3. The Senate shall be their duty to have a senate meeting at least once a
month.
4. Each senator shall be expected to bring to the senate suggestions and
recommendations for improvements from the classroom they
represent. Each Senator represents the students from their first period class.
5. The Senate shall be their duty to promote all ASB co-curricular and
curricular activities and direct discussions in their first period class.
SECTION 3. Cause for Removal from Senate
CLAUSE A. A senator may be removed from their position as a Senator if their conduct
is in question. A Senator can be removed in the following ways:
1. Student is involved in an activity that is deemed inappropriate or unacceptable for a leader of San Pasqual Academy.
2. A student council member or Senate member may request a Senator to be dismissed by written request to ASB advisor or ASB President.
3. At the next Senate meeting, a discussion, led by the person requesting the dismissal will be held. The Senator in question will have a chance to speak on his behalf. The Senator in question may have someone speak on his or her behalf.
4. A simple majority vote of all Senators and ASB council members will be taken, led by the ASB Vice President.
5. A dismissal of a Senator will be replaced through the selection process listed in Article VI, Section I.
ARTICLE VII. CODE OF CONDUCT
SECTION 1. Code of Conduct during ASB Council and Senate Meetings
1. When making a commitment, Council member or Senator promises to follow
through to completion.
2. Take an active role in activities and discussions.
3. Show respect towards others’ opinions. Stand and voice their own opinions,
and be open-minded.
4. Be ready to take on the role of a school leader and put aside your own wants
and desires and make decisions based on the overall betterment of the school.
5. Use of profanity, vulgarity or inappropriate language is not accepted and can
be cause for dismissal from ASB or Senate meeting.
ARTICLE VIII. ASB ELECTIONS –TERMS OF OFFICE
SECTION 1. Any election in which the student body as a whole takes part shall be
considered an ASB election.
SECTION 2. The following procedure shall be adhered to in an election:
CLAUSE A. The Australian ballot shall be used.
CLAUSE B. To win an election, a candidate must receive a plurality
of the votes cast.
CLAUSE C. When a candidate runs unopposed, a plurality of all votes cast shall
be required.
SECTION 3. Terms of Office
CLAUSE A. Officers shall assume their respective duties during the last week of
the spring semester and shall serve for one (1) year.
CLAUSE B. Two (2) persons selected during the fall will represent the freshman
class on the ASB Council.
CLAUSE C. Officers must serve for the entire school year. The principal will not
approve midterm graduation for the student body or class officers.

CLAUSE C. Interns
No more than four (4) and no less than two (2) Interns shall be appointed
SECTION 5. Referendum, Recall and Filling Vaccines
CLAUSE A. If a vacancy occurs in any elective office, the council shall appoint a
commissioner to fill the unexpired term. In case of a vacancy in the
office of ASB President, the ASB Vice-President shall succeed to the
office and a new ASB Vice-President shall be appointed.
ARTICLE IX SCHOOL CLUBS
SECTION 1. Requirements for Club shall be as follows:
CLAUSE A. You must have a minimum of three (3) students with an adult
sponsor to start a club. The club will be voted on from the ASB council for a club to be admitted by a simple majority.
CLAUSE B. In order to be considered for a club, the following information must be
submitted to the ASB council.
1. A goal or mission with a valid purpose.
2. You cannot create a club that is against school policy (has to be school
appropriate.)
3. You must fill out a club request form and the adult sponsor must meet with
the ASB advisor.
